The BlueberryRx website is solely funded by Creative Health Ventures, LLC, a privately held company (“Creative Health”). Creative Health is committed to protecting your privacy online. We use what we believe to be state-of-the-art technology to ensure that your personal information can be stored and retrieved securely and safely. This Privacy Policy and Agreement (“Privacy Policy"), as amended from time to time, will tell you what information we collect about you and your use of our website, and will explain how we protect your private information and what choices you have about how it is used.
We urge you to read this Privacy Policy carefully so that you clearly understand both our commitment to you and your privacy and how we collect and use any provided information. By using the Creative Health website, you agree to the terms of this Privacy Policy. If you do not agree to this Privacy Policy, you should immediately discontinue use of the BlueberryRx website and/or the prescription reminder services delivered through the BlueberryRx website (the “Reminder Service”).
In particular, this Privacy Policy describes:

• What 'cookies' are and how may we use them;
• What relationships Creative Health has with third parties and how they relate to you;
• What choices are available regarding collection, use and distribution of the information;

A. Information we collect
We collect your information in order to record, support and facilitate the delivery of the Reminder Services. At the time you register on our site, we collect and store your name, address, credit card numbers and other personally-identifying information. We need this information to provide the Reminder Services that you request and to let you know of additional services about which you might be interested. We may also use this information to customize your experience using the BlueberryRx website.
In addition, when you create your medication record and your medication regimen, you will enter your pertinent medication and the regimen in respect thereof. When you have completed the registration process or thereafter, we will send you an e-mail confirming your subscription. During the registration process, you will have the option to “opt in” or “opt out” of receiving marketing materials from www.BlueberryRx.com and/or its affiliates.
B. Contact with Members
Our primary method of communication with subscribers will be e-mail. Creative Health will send subscribers a general, unsecure, and unencrypted e-mail alert to notify them when changes are made in their account. We will keep disclosure of personal identifiable information in these e-mails to the minimum amount of such information practicable, although sometimes it might require certain information be disclosed in order for the e-mail alert to be helpful for the purpose of verification. We will also contact members through their Cell Phone, Home Phone and Work Phone or other numbers when a subscriber has chosen telephone and/or text message notification for receiving the Reminder Service.
C. Cookies
Cookies are small computer files that we transfer to your computer's hard drive that provides us information as to how often someone visits our website and the activities they conduct while on our website. You should never change or stop any course of treatment prescribed by your physician without consulting him or her. Creative Health is not responsible for the accuracy or completeness of any information added, deleted or modified by a subscriber at any time.
Creative Health does not represent or endorse the accuracy or reliability of any of the information, content or advertisements contained on, distributed through, or linked, downloaded or accessed from any of the services contained on its website or any of the websites of its partners, nor the quality of any products, information or other materials displayed, purchased or obtained by you as a result of an advertisement or any other information or offer in or in connection therewith.
E. Children
Creative Health's services and tools are intended for adult use only. A parent or guardian, however, may establish an account to use the Reminder Service for a minor. The parent or guardian is solely responsible for providing supervision of the minor's use of the Reminder Service and to ensure that medication is administered or taken when and as required. The parent or guardian assumes full responsibility for ensuring that the authentication information is kept secure and that the information submitted is accurate.
F. Disclosure of your information
Our service is to help consumers store their medication regimen in a safe place and provide reminders in respect thereof, and our business model is not dependent on selling any individual's information. Except as set forth in this section or as specifically agreed to by you, Creative Health will not disclose any personal information it gathers from you on the BlueberryRx website which would have the effect of personally identifying you. We may release personal information to third parties: (1) to comply with valid legal requirements such as a current law, regulation, search warrant, subpoena or court order; or (2) in special cases, such as a physical threat to you or others. In the event that we are legally compelled to disclose your personal information to a third party, we will notify you unless doing so would violate the law or court order.
Disclosure to or by co-branded channel Partners
Creative Health is a service provider and may provide co-branded services to websites hosted and operated by companies other than Creative Health. You may only be able to access these co-branded services through the partner website. The co-branded Creative Health pages that you may access through a partner website may have different registration processes and opportunities for information collection. Each of these co-branded Creative Health websites may have its own privacy policy posted on that site, which explains what information is disclosed by Creative Health to the partner and vice versa. If you visit one of these co-branded Creative Health websites, please read the privacy policy that is posted on that website, as well as the individual privacy policy of the partner website.
Disclosure of aggregate information
Creative Health may combine, in a non-identifiable format, the health information you provide with health information from other users to create "aggregate data" that may be disclosed to third parties. For example, Creative Health may use information gathered to create a composite profile of all the users of a particular partner website. Partnering websites may use this information to understand community needs and to design appropriate programs and activities on their website. Aggregate data does not contain any information that could be used to contact or identify you. Creative Health will not disclose your personally identifiable information to any third party without your prior authorization.
G. Internal protection of your records
We employ the following practices to protect your privacy:
- We use passwords and your email address to authenticate your access to personal information before granting access to such information. Your password is encrypted. We recommend that you do not divulge your password to anyone. In addition, your information resides on secure servers that only selected Creative Health personnel and contractors have access to via password.
- We limit access to your personal information to authorized users. Creative Health lets you have full control over who has access to your medication records and regimen in respect thereof. For example, you may permit your relatives or health care professional to view your records. Only the person who creates a record can grant such access to other users.
Despite Creative Health's efforts to protect your personal information, in certain limited circumstances we may be legally compelled to release your personal information in response to a court order, search warrant, subpoena or other valid legal action.
Furthermore, there is always some risk that an unauthorized third party may find a way to thwart our security systems or that transmissions of your personal information over the Internet will be intercepted.
H. Your privacy choices
Removing or modifying your information
Creative Health provides users with the ability to (i) remove, alter, amend or modify their information stored in our database, and (ii) opt not to receive future communications or to no longer receive the Reminder Service, by clicking on http://blueberryrx.com/subscribers/cancelsubscription.aspx. If for some reason you are unable to do any of the foregoing, please e-mail us at admin@BlueberryRx.com with your request.
Limitations to removing your information
The need to back-up our systems to protect information from inadvertent loss means that a copy of your personal information may exist in a non-erasable form that will be difficult or impossible for us to locate. Nevertheless, we promise that upon receiving your request, all personal information stored in the databases actively used for research, daily business activities, and other readily searchable media, will be deleted.
Notification of changes in the privacy policy
If we decide to change our privacy policy, we will post these changes on this page so that you are always aware of what information we collect, how we use it, and under what circumstances we disclose it.
